Felony unauthorized use of a motor vehicle
On April 18 at 3:18 a.m., the sheriff’s office received a report of a stolen vehicle. A deputy soon learned that Thomas Adam Gallaway, 32, Grafton, N.D., was found a short time earlier with the vehicle outside of Northside Express in Fertile. Gallaway has been charged with felony unauthorized use of a motor vehicle in Polk County. He was arrested. According to the complaint, a Polk County sheriff’s deputy saw the sport utility vehicle outside of the gas station at about 2:42 a.m. He conducted a traffic stop nearby and then again noticed the SUV and a man walking around outside. The man, later identified as Gallaway, didn’t make any sense, saying he was there with others. No one else was in the vicinity. He also said he was waiting for his dad to pick him up and that the vehicle belonged to his ex-girlfriend, who lives in Grand Forks, N.D. The deputy determined the vehicle belonged to a Red Lake Falls woman who was, around that time, filing a report about her stolen vehicle. She told a Pennington County deputy that she borrowed the vehicle to Gallaway, her boyfriend. However, he never returned it. The Pennington County deputy spoke to Gallaway by phone, saying the vehicle needed to be returned by 2:45 a.m. Gallaway said he was in North Dakota and never showed up. He then shut off his phone. When speaking with the Polk County deputy, Gallaway said he didn’t know the woman who owned the vehicle. He said she knew his uncle. Multiple prescription bottles featuring Gallaway’s name and two empty bottles of cyclobenzaprine were found in his possession. The latter prescription had been filled March 8 and had a refill date in November. After being taken to jail, Gallaway was confused about where he was and changed his story several times.
